IBIR System Terms Of Use

The Terms and conditions set forth below (the "Terms") govern your use of the IBIR system (the "System"), and are legally binding on you. If you do not agree with any of these Terms, do not access or use this System or any information contained herein.

General Use Restrictions

All information, entry forms and services provided by this System (the "Content") are provided by MedicKnowledge or its affiliates, and are the copyrighted work of MedicKnowledge and/or the third party providers, as applicable. MedicKnowledge grants you the limited right to view and use this System, provided that MedicKnowledge representative granted you the permission to use the system by supplying valid account details. This limited license terminates automatically, without notice to you, if you breach any of the Terms. Except as stated herein, you agree that none of the Content may be displayed, posted, downloaded, copied, distributed, republished, or transmitted in any form or by any means, including without limitation electronic, mechanical, photocopying or otherwise, without the advance written authorization of MedicKnowledge or its applicable third party providers. In addition, you agree that no part of the System, including trademarks, logos, graphics or images, may be copied or retransmitted in any way, in whole or in part, without the advance written authorization of MedicKnowledge. You acknowledge that nothing on this System shall be construed as conferring any license to you of MedicKnowledge' or any of its third party providers 's intellectual property rights, whether by estoppels, implication, or otherwise, and agree that you have sole responsibility for obtaining any such licenses by separate written agreement. Any unauthorized use of any Content contained on this System may violate copyright laws, trademark laws, the laws of privacy and publicity, and certain communications statutes and regulations.

Third Party Content Disclaimer

You acknowledge that any Content provided by third party providers s have not been independently authenticated in whole or in part by MedicKnowledge, and agree that MedicKnowledge does not and shall not provide, sell, license, or lease any of the Content other than those specifically identified as being provided by MedicKnowledge. You acknowledge that any license to use Content from third party providers will be contracted for directly between you and the applicable Third party providers. MedicKnowledge assumes no liability, obligation or responsibility for any part of any such correspondence or promotion.

This System may be linked to other websites on the World Wide Web which are not under the control of or maintained by MedicKnowledge. Such links do not constitute an endorsement by MedicKnowledge of those websites. You acknowledge that MedicKnowledge is providing these links to you only as a convenience, and agree that MedicKnowledge is not responsible for the content of those Systems.

Information Submissions

Unless otherwise explicitly stated by an agreement between you and MedicKnowledge, you agree that any breast implant information provided by you with this System is provided on a non-proprietary, non-exclusive basis. MedicKnowledge shall be free to include this information in the International Breast Implant registry analysis and\or reports. You acknowledge that you are responsible for the information you register, and you, not MedicKnowledge, have full responsibility for the information, including their legality, reliability, appropriateness, originality and copyright.

Limitation of Liability

To the maximum extent permitted by applicable law, MedicKnowledge shall not be liable for any damages suffered as a result of copying, modifying or distributing the information in the System. We do our best to maintain the accuracy of personal information you supply to us, and to follow-up if any of the information proves incorrect or becomes outdated

Miscellaneous

This System may include inaccuracies or typographical errors. MedicKnowledge reserves the right to perform improvements and/or changes in the system and its features. MedicKnowledge can revise these Terms at any time without notice by updating this posting. If any provision of these Terms is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, with all other provisions remaining in full force and effect. The failure of MedicKnowledge to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by MedicKnowledge in writing. The Terms comprises the entire agreement between you and MedicKnowledge and supersede all prior or contemporaneous agreements between the parties regarding the subject matter contained herein.

MedicKnowledge recognizes the need for appropriate protection and management of personally identifiable information you share with us (any information by which you can be identified, such as name, address, country, and telephone number). For this reason, MedicKnowledge has established this privacy policy (the "Privacy Policy"), so that you can understand how we carefully treat your information. In general, your information is confidential and is not accessible to other users under any circumstance. In addition, the medical records you register cannot be seen by other users (surgeons) unless you or the organization of which you are a member explicitly states otherwise.
